1. Booking and Confirmation

1.1 Booking Process: To book a tour, you can contact me directly via email, WhatsApp, or through the contact form on my website. I will respond within 24 hours to confirm availability and provide you with a personalized itinerary.

1.2 Confirmation: Your booking is confirmed only when I receive the required deposit payment and send you a written confirmation via email or WhatsApp. Please review all details carefully and inform me immediately of any errors.

1.3 Minimum Group Size: Some tours may have minimum group size requirements. If the minimum is not met, I reserve the right to cancel or reschedule the tour with full refund or offer alternative dates.

1.4 Accuracy of Information: You are responsible for providing accurate and complete information when booking, including full names (as they appear on passports), contact details, and any special requirements.

2. Payments and Pricing

2.1 Pricing: All tour prices are quoted in US Dollars (USD), Sri Lankan Rupees (LKR), or as otherwise specified. Prices are subject to change until the tour is confirmed. Once confirmed, the price is guaranteed.

2.2 Deposit: A deposit of 30% of the total tour cost is required to confirm your booking. The deposit is non-refundable except as outlined in the cancellation policy.

2.3 Final Payment: The remaining balance is due 30 days before your tour start date. For bookings made within 30 days of travel, full payment is required at the time of confirmation.

2.4 Accepted Payment Methods: I accept bank transfer, credit/debit cards (via secure payment links), and cash on arrival (for last-minute bookings with prior arrangement). Please note that credit card payments may incur a 3% processing fee.

2.5 Taxes: All prices include applicable Sri Lankan government taxes and service charges unless otherwise stated.

4. Itinerary Changes

4.1 Flexibility: As a solo guide, I pride myself on flexibility. While I strive to follow the agreed itinerary, I may need to make adjustments due to weather conditions, road closures, or other unforeseen circumstances.

4.2 Major Changes: If significant changes are required, I will discuss alternatives with you and seek your agreement. You have the right to accept the changes or cancel with a full refund for the affected portion.

4.3 Optional Activities: Some activities mentioned in itineraries (hot air balloons, diving, etc.) may be weather-dependent or require advance booking. I will assist with arrangements but cannot guarantee availability.

5. Client Responsibilities

5.1 Travel Documents: You are responsible for ensuring you have a valid passport (minimum 6 months validity beyond your stay) and the correct visa for Sri Lanka. I can provide guidance but am not responsible for visa issues.

5.2 Travel Insurance: Comprehensive travel insurance is MANDATORY for all clients. Your insurance should cover medical expenses, trip cancellation, baggage loss, and personal liability. I require proof of insurance before tour commencement.

5.3 Health Requirements: You are responsible for ensuring you are medically fit for the tour activities. Please consult your doctor for recommended vaccinations and medications before traveling to Sri Lanka.

5.4 Punctuality: Please be ready at agreed pickup times. I will wait for a reasonable period (usually 30 minutes) but delays may affect the day's itinerary. If you are running late, please notify me immediately.

6. Liability and Insurance

6.1 My Liability: I operate as an independent tour guide and take reasonable care to ensure your safety. However, I am not liable for:

• Injury, illness, or death (except where caused by my negligence)
• Loss or damage to personal belongings
• Events beyond my control (natural disasters, political unrest, etc.)
• Acts of third parties (hotels, restaurants, other service providers)

6.2 Vehicle Insurance: My tour vehicles are fully insured for passenger liability as required by Sri Lankan law. However, this insurance does not cover your personal belongings.

6.3 Third-Party Services: When I book hotels, restaurants, or activities on your behalf, I act as an intermediary. I select reputable providers but am not responsible for their services. Any issues should be taken up directly with the provider, and I will assist in communication.

7. Force Majeure

I am not liable for any failure or delay in performing obligations due to circumstances beyond my reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, strikes, pandemics, government restrictions, or any other unforeseen events. In such cases, I will attempt to offer alternative arrangements, but no refunds will be provided for circumstances beyond my control.

8. Client Conduct

8.1 Respectful Behavior: I expect all clients to behave respectfully towards me, other travelers, locals, and Sri Lankan culture and customs. This includes appropriate dress at religious sites, following photography rules, and respecting local traditions.

8.2 Disruptive Behavior: I reserve the right to terminate a tour immediately without refund for any client whose behavior is disruptive, dangerous, illegal, or causes distress to others. This includes intoxication, aggression, illegal activities, or persistent disrespect of local customs.

8.3 Illegal Substances: Sri Lanka has strict laws against drugs. Possession or use of illegal substances will result in immediate termination of services and reporting to authorities. No refund will be given.

9. Complaints Procedure

9.1 During the Tour: If you have any concerns during your tour, please tell me immediately. As a solo operator, I can address issues most effectively when they arise. I genuinely want you to have the best experience possible and will do my utmost to resolve any problems promptly.

9.2 After the Tour: If you need to make a complaint after your tour, please contact me in writing via email within 14 days of tour completion. I will acknowledge receipt within 48 hours and provide a full response within 14 days.

10. Governing Law

These Terms and Conditions are governed by the laws of Sri Lanka. Any disputes arising from your tour shall be subject to the exclusive jurisdiction of the courts of Sri Lanka. I encourage amicable resolution of any issues and am always open to discussion before legal action is considered.

11. Photography and Marketing

11.1 Personal Photos: I occasionally take photos during tours for my personal memories. If you prefer not to be photographed, please let me know, and I will respect your wishes.

11.2 Marketing Use: From time to time, I may ask your permission to use photos from your tour on my website or social media. I will always ask for your explicit consent before using any image that identifies you. You are free to decline without any impact on your tour.
